Terms and Conditions

1. Nature of the platform

Airflex is a digital platform that enables users to discover aircraft and operators, submit charter enquiries or requests for quotations, review selected information, and interact with Airflex and participating operators.

Unless expressly stated otherwise in a separate written agreement, Airflex operates as a technology-enabled discovery, enquiry, lead-routing, membership, and coordination platform. Airflex does not automatically become the operating carrier, aircraft owner, operator, charter service provider, or contracting airline merely because an aircraft or operator appears on the platform.

Any charter, flight, aircraft availability, quote, schedule, service standard, baggage allowance, onboard service, cancellation outcome, or final trip execution may be subject to a separate agreement between the customer and the relevant operator or service provider.

2. Eligibility

You may use Airflex only if you are legally competent to enter into a binding contract under applicable law. If you are acting on behalf of a company, family office, travel desk, partnership, trust, or any other entity, you represent that you are authorised to act on its behalf.

3. User accounts

To access certain features, you may be required to create an account, provide identification details, or subscribe to a membership plan. You agree to provide accurate, current, and complete information and to keep your account credentials confidential.

You are responsible for all activities carried out through your account unless you notify Airflex promptly of unauthorised access.

4. Platform information and listings

Airflex may display aircraft details, images, categories, performance information, seating, cabin features, operator details, route suitability, or service descriptions based on information submitted by operators, public information, or internal curation.

While Airflex seeks to keep platform information current and accurate, Airflex does not guarantee that every listing, image, seat count, amenity, specification, certification, route suitability statement, or availability indicator is complete, current, or error-free at all times.

Aircraft availability is dynamic and may change without notice.

5. Quotes and booking requests

A request, enquiry, shortlist action, concierge request, or quote submission through Airflex does not by itself confirm a booking.

A booking is only confirmed when the relevant service terms, commercial terms, operator acceptance, and payment conditions are expressly agreed in writing by the relevant parties.

Airflex may assist in coordination, but Airflex reserves the right to refuse, delay, suspend, or decline any request where there are operational, legal, safety, payment, compliance, reputational, sanctions, documentation, or feasibility concerns.

6. Memberships and fees

If Airflex offers paid memberships, subscription access, concierge access, or premium discovery plans, the applicable benefits, validity period, fees, taxes, renewal terms, and exclusions will be described on the relevant plan page or proposal.

Unless expressly stated otherwise, membership fees cover access to platform features or concierge benefits and do not include the cost of charter flights, airport charges, operator charges, taxes, or third-party expenses.

7. Payments

Where payments are accepted through the website or linked channels, you agree to pay all applicable amounts, taxes, convenience fees, banking charges, or other disclosed charges.

Airflex may suspend fulfilment, access, or confirmations if payments fail, are reversed, or are flagged for fraud, compliance review, or chargeback risk.

8. Prohibited use

You agree not to:

• misuse the platform or access another user's account;
• scrape, harvest, copy, or systematically extract listing or operator data without permission;
• submit false, misleading, illegal, or fraudulent requests;
• attempt to interfere with platform security, infrastructure, APIs, or workflows;
• use Airflex for unlawful, sanctioned, or restricted activities;
• upload malicious content or documents;
• infringe intellectual property or confidentiality rights.

9. Intellectual property

All platform design, content structure, text, software, branding, graphics, workflows, and compilation of platform materials are owned by or licensed to Airflex unless otherwise stated.

Operator logos, aircraft images, and third-party trademarks remain the property of their respective owners.

10. Privacy and data use

Your use of the platform is also governed by the Airflex Privacy Policy. By using Airflex, you agree to the collection and use of information as described in that policy.

11. Limitation of liability

To the maximum extent permitted by law, Airflex shall not be liable for indirect, incidental, special, consequential, reputational, loss-of-profit, loss-of-opportunity, or data-related damages arising from your use of the platform.

Airflex shall not be responsible for operator actions, aircraft substitution, delays, cancellations, regulatory restrictions, weather disruptions, airport restrictions, crew limitations, force majeure events, or third-party defaults unless expressly accepted in writing.

12. Indemnity

You agree to indemnify and hold harmless Airflex, its affiliates, officers, employees, consultants, and partners against claims, losses, liabilities, and expenses arising out of your misuse of the platform, breach of these terms, unlawful conduct, or inaccurate information submitted by you.

13. Suspension and termination

Airflex may suspend or terminate accounts, listings, memberships, or access in case of suspected fraud, misuse, policy breach, payment default, regulatory concern, or risk to the platform or other users.

14. Governing law and dispute resolution

These Terms and Conditions shall be governed by the laws of India. Subject to applicable law, courts at Bangalore, India shall have jurisdiction.

15. Changes to terms

Airflex may update these Terms and Conditions from time to time. The updated version will be posted on the platform with the revised effective date.
